IN CONSIDERATION of the mutual covenants and agreements herein contained, Landlord hereby leases to Tenant and Tenant hereby leases from Landlord the above described property under the following terms:  
   
1.    TENANT, FEES and DEPOSITS: Tenant renting this unit must be minimum of 25 years or older. This lease shall be for a period defined in payment agreement   Refundable damage deposit is $250 and one-time cleaning fee is $175.  State and Local Tax is 13%.  Damage deposit will protect owner against damage and theft to the property.  Damage deposit will be returned after Tenant vacates the property and Landlord receives a report from cleaner that the Property is not damaged, or no theft has occurred.   If damage exceeds $250 then Tenant is responsible for the remaining part of the damage. Please allow 7 days for return of the deposit.  
  
2.    All towels and linens provided in the condo are ours. Missing or Stained linens will be charged to guests' deposit as follow:  Bath towels $20; Hand Towels $10; Washcloths $5 Bathmats $15; Sheets at Cost; Missing pillow and case $30.  Cleaning cost of stained comforter, upholstery or carpet will be charged to Guest's deposit.     
  
UTILITIES.  Landlord pays all utility charges on the property. Please do not leave sliding doors open while operating AC.  Moisture may freeze up the evaporator coil in the air handler and may cause damage to the system. If that happens Tenant is responsible for the cost of repairs or replacement of the unit. Please keep AC at 74 F in order for us to keep rental fees manageable.   
  
3.    CONDITION and USE: Tenant shall examine the property upon arrival and let us know if there is any damage. Tenant shall not use the premises for any illegal purpose and shall not cause a nuisance for neighbors.  
  
4.    CLEANING: Garbage chute is located on the west end of the unit (opposite site to the elevator).  At the end of the lease, items in the condo shall be in the condition and the order as at the beginning of the term, except linens, towels, and beds.  
  
     Please do not wash towels or linen at the end of your stay.  That is cleaners' job; part of your cleaning fee is for washing them. However, you are welcome to wash them during your stay.  
  
5.    CHECK IN and OUT:  Check in is 4pm and check out is 10am.  
  
6.    PETS and SMOKING:  NO Pets or Smoking shall be allowed on the premises including in the balcony. If smoked there will be $50 or more to treat the unit, if you bring un-authorized pet, fee for pet is $250 or more which will be charged to guest's deposit.   
  
7.    PARKING.  HOA charges $20 parking fee for each vehicle. Up to two vehicles are allowed per unit. There is one permit by the front door in the unit and an additional permit should be under the TV in the living room if needed.  Please fill out the additional permit for your stay and unit number and place the permit provided on your vehicles' rearview mirror or dashboard.  
  
8.    ATTORNEY'S FEES.  If it becomes necessary to enforce this agreement through the services of an attorney, tenant shall be required to pay Landlord's attorney's fees.  Tenant shall be required to pay any collection fees rendered.    
    
9.    SURRENDER OF PREMISES.  At the expiration of the terms of this lease, Tenant shall immediately remove its goods and effects and peaceably yield up the premises to Landlord in as good a condition as when delivered to Tenant, ordinary wear and tear excepted.

Seachase 
Rules and Regulations   
   
   
The following rules and regulations have been adopted by Seachase Homeowners Association, Inc. ("Association") and are designed to ensure that all unit owners, renters, and guests have a safe and pleasant stay at our facilities. All owners, renters, and guests are asked to assist in this effort by adhering to these rules and regulations and by helping with enforcement by asking violators to comply.   
   
1.    PARKING PASSES for owners and guests should be displayed on the rearview mirror or dashboard. Owners or rental guests should obtain parking passes from the rental agency or the Association manager.  Unauthorized vehicles will be towed at owner's expense. Parking is not allowed in the fire lanes. All vehicles must park between the solid lines. Each condominium unit is allowed two parking spaces.   
   
2.    LUGGAGE CARTS are located on the ground floor near the elevators. Do not take carts into the units. Carts must be returned to the ground floor when finished.   
   
3.    SMOKING is prohibited in the common elements of Seachase including but not limited to the pool area, parking lots, and walkways.  Smoking is only allowed on the beach and on unit gulf-side balconies with the unit owner's permission.   
   
4.    FIREWORKS of any kind are prohibited on Seachase property.   
   
5.    OCCUPANCY RESTRICTIONS:  Bay County codes permit no more than eight persons in a two bedroom unit.  Violators will be evicted and owners of units found in violation are subject to a fine.   
   
6.    BALCONIES/WALKWAYS:  Feeding birds from the balconies violates Florida State Law Title XXVIII Chapter 379.412, and is "punishable by a civil penalty of $100." Throwing, pouring, sweeping, or shaking any item (such as water, cigarette butts, ice, etc.) from the balconies is strictly prohibited.Balconies may not be used to hang garments and/or towels out to dry. Balconies may not be washed off with hoses unless proper notification given to association management. Balconies may be mopped. Violators are subject to eviction, arrest and/or fine.    
   
7.    ELEVATORS, WALKWAYS, AND STAIRWELLS: Walkways, stairwells, and landing areas shall not be obstructed (i.e., beach chairs, coolers, floats, or other objects), nor should children be allowed to run      or play in these areas. Overcrowding or jumping in the elevators will cause the elevator safety mechanisms to shut down the elevator. Occupants will be confined inside until a technician can be dispatched (1-2 hours) and violators will be charged for the service call.   
   
8.    HANDRAILS: Balcony handrails are life-saving devices. Do not pound or kick the handrails.       
   
9.    PETS:  Owners and guests with pets must keep the pets under control at all times, and are responsible for picking up and disposing of pet waste in pet waste stations located on the property.  Should a unit owner or guest fail to clean up after their pet, the Association shall perform that service and the person failing to pick up and dispose of the waste will be subject to a fine. Except for emotional support animals and service animals, pets are not allowed in the pool area or on the beach.
The Association may require the removal of any pet which harms anyone or creates a disturbance for other owners.   
   
10.    TRASH should be deposited in the trash chutes at the end of each floor. All trash deposited in the trash chute must be bagged and securely tied. Oversized Items must be taken to the dumpster in the parking lot of each building. Furniture, construction debris, and packing materials of any kind must not be put in the association dumpster. Any discarded items traceable to a unit owner are subject to a fine per occurrence.   
   
11.    NOISE:  The playing of music, radios, televisions, and musical instruments must not exceed a reasonable volume at any time.  Between the hours of 10:00 PM and 10:00 AM, noise shall be kept at a volume that cannot be heard outside the unit in which it is located. All residents and guests shall refrain from any activity that would disturb other residents, such as yelling or shouting from balconies and pool deck. The Panama City Beach Police Department will be called to assist in addressing loud noises or any other actions that interfere with the rights or comfort of other owners, renters, or guests. Non-owner violators risk eviction for noncompliance.   
   
12.    SKATEBOARDS/ROLLERBLADES are not permitted on Seachase property.   
   
13.    SAND DUNES:  It is against the law to pick or walk on the sea oats. Please use designated walkways around the dunes.   
   
14.    PROPERTY DAMAGE/DESTRUCTIVE BEHAVIOR:  Any behavior by owners or their guests that would be considered dangerous or destructive is strictly prohibited. Anyone found vandalizing or destroying the property will be billed for damages and will be evicted.   
   
15.    ANTI-SLAM DOOR CLOSERS have been installed in each unit to prevent damage to door frames and the risk of injury related to the door closing too quickly. Owners may not remove these devices and should report any malfunctions to the Association manager for repair.   
   
16.    POOL is open from 8:00 AM to 10:00 PM daily. Use of the pool is restricted to owners, guests, and renters.  All users must comply with the posted rules. Owners, guests, and renters are responsible         for the conduct of their children while in the pool area. Removal of equipment/furniture from the pool deck is prohibited. No animals except service animals are allowed in the pool area.   
   
17.    ILLEGAL DRUG USE on Seachase property is strictly prohibited.  Please note that the use of cannabis in any form except for authorized medicinal purposes is illegal.  All violators will be reported to the appropriate law enforcement agency and prosecuted to the full extent of the law.
